  • What is Claims Estimation? Maryland Bankruptcy Attorney

Thoughts from a Maryland Bankruptcy Attorney http://www.drescherlaw.com There’s a procedure under the Bankruptcy Code that’s called claims estimation that's used when litigation threatens to drag on for months or even years. before the amount of a claim that is owed to a creditor is actually liquidated and becomes a certain amount. That could be a problem because the debtor wants to file a plan of reorganization and circulate the plan to creditors, have the creditors vote (which is based upon the amount of money that the creditors are owed) and then have the plan confirmed so that the debtor can exit bankruptcy. But if one large claim is tied up in litigation, that can delay the process. What you can do under those circumstances is something called claims estimation, where the debtor or ...

Our workers' compensation attorneys have more than 100 years of combined experience. Don't delay, call today for a Free Consultation. Being injured at work can be one of the most painful, disruptive, and confusing events that can happen in a person’s life. If you are unable to work, the loss of income can be extremely burdensome on an injured worker and their family. If you don’t have health insurance, you may not know how to pay for medical treatment. And if you’ve sustained a permanent injury, you may wonder how you’ll ever make ends meet in the future. Worrying about these issues on top of dealing with pain can be overwhelming. Your attorney can help you get disability benefits, medical treatment, and even a lump sum award if you’ve sustained a permanent injury. One of the greatest values of retaining an attorney is that you will have someone who is on your side to protect your interests, financial and medical, every step of the way. Here are some of the most common reasons that workers compensation claims are denied and how hiring an experienced attorney can prevent these things from happening to you. Injured workers’ claims are frequently denied on the basis that a causal connection is lacking, i.e., the injuries were preexisting. Your attorney can set you up with a doctor of your choice to examine you and provide an unbiased opinion as to the cause of your injuries. Your attorney can negotiate with the insurance company using your doctor’s opinions to attempt to get your claim accepted. Sometimes, an injured worker’s claim is initially accepted and you receive some medical treatment and some disability benefits. But then the checks stop coming. Your attorney can help you by setting you up with an unbiased doctor. Your attorney can then use your doctor’s report to file issues on your behalf and obtain an order forcing the insurance carrier to pay your benefits.

What you can do under those circumstances is something called claims estimation, where the debtor or some other party can file a motion with the bankruptcy court and ask the judge to give an idea of how the litigation will end for the purpose of voting or for the purpose of an interim distribution. Essentially, the judge is going to estimate the amount of the claim based upon a best guess of how the litigation will turn out. The claims estimation procedure is not a trial and is not binding on what’s going to happen later at a full evidentiary hearing on the claim, but it does give the litigants a useful idea. It gives them an idea about how the judge may rule later on and in any event it’s going to make life much easier towards confirming a plan in the case. Thoughts from a Maryland Bankruptcy Attorney http://www.drescherlaw.com When clients are filling out their bankruptcy schedules there's a space in the form for a debtor to indicate if a claim is contingent, unliquidated or disputed.  In this video I talked about contingent claim meaning a claim where liability that is not certain to occur and it's only going to occur upon an event happening.   The classic case of a contingent liability is the personal guarantee of a promissory note.  If the main borrower under that note doesn't default under the note, then the obligation under the guarantee will never arise so it's contingent upon the occurrence of an event of default under the promissory note.   An interesting kind of contingent claim happens when you go to a casino.  If you place a bet on roulette red or black, while the ball is still spinning around the wheel the casino has a contingent claim owed to you based upon whether or not the ball lands on the red or the black or the green zero or double zero square.  If the ball lands on the square that you bet on, then the claim becomes matured and fully due.  If the ball lands on a different square, then the casino isn't going to owe you anything but during that interim period, the casino has a contingent obligation to you depending upon what happens where the ball drops. My name is Ron Drescher.  I'm an attorney practicing bankruptcy and commercial litigation.  If you have a question about whether or not your claims are liquidated, disputed or contingent, please pick up the phone and call me.  I would love to hear from you. http://bostonlawllc.com http://bostonlawllc.com/web/content/if-my-maryland-medical-malpractice-claim-can-settle-how-long-will-it-take So you think that you have a Maryland medical malpractice case but you want to know how long will it take to settle the case? Want to hear the answer? Stay tuned. Hello, I am Maryland medical malpractice attorney Marcus Boston and I want to briefly talk with you about how long it will take to settle your medical malpractice claim. The simple answer is that it can really vary. The reason that I say this is because there is a lot that goes into these cases. For example, you will have to request all of your medical records. After this, these records must be examined by an expert to determine whether your treating medical professional broke any of the safety rules, or standard of care in your situation. After your expert has reviewed the records, he or she will then relay this information to your attorney for analysis and discussion. Depending on the amount of records, and the complexity of the case, the time frame for all of this varies. In addition, an assessment will have to be made as to the extent of your injuries. On top of this, we have not even gotten to filing and whether depositions will be held. As you can see, this is a very long and complex process which deals with multiple players. And to top it off, this is not every detailed event in the process. The reason why I have shared some of this with you is because if you are looking for your case to be over in say 30 days or so, walk away now. In some instances these cases can take years to settle and this assumes the case can be settled. Sometimes the other side will just take their chances at trial and drag things out even longer. So why am I explaining all of this to you today? So you can have insight and education as to the medical malpractice process here in Maryland. So you can really think about is this something you want to put yourself through, and possibly your family if you have one. If you want to speak to someone more about all of this, and whether you may have a Maryland medical malpractice claim, pick up the phone and give me a call. I can be reached at 301-850-4832. Or if you would prefer to email, send an email to medical injury "at" bostonlawllc.com.com (Remember to replace the "at" with @). We answer questions like yours all the time regarding Maryland law.

http://bostonlawllc.com Maryland medical malpractice attorney Marcus Boston talks about how you can go about finding the best medical malpractice attorney for your case. Your doctor has made a very bad mistake during your surgery and you are now wondering, do you have a claim. This mistake could have been a perforated bile duct during gallbladder surgery, to mistakes made by your perioperative team before surgery. But regardless, how do you go about finding the best Maryland medical malpractice attorney for your case? One factor you should take into consideration when trying to find a Maryland attorney for your medical malpractice claim. And what is it you are wondering? How much information do they have on the web for you to educate yourself about not only your possible claim, but would you be a good fit for that lawyer and law firm. Let's face it, going to see a lawyer can be a scary thing when you have no idea as to what the process is all about. Even more basic than that, how do you even know if you will like the lawyer you are thinking about hiring? Remember these types of cases take a long time and you do not want to be stuck with someone you may not really be a good fit. For example, you are watching this video right now and you get to see who I am, and not in some stuffy big lawyer words way, just plain English. This is what I mean by gathering information before hiring the attorney. If you have any questions for me, or would like for us to mail to you a complimentary copy of our latest book on what you need to know before filing a medical malpractice case here in Maryland, give me a call at 301-850-4832. If email would be better, send me an email at medicalinjury "at" bostonlawllc.com (Remember to replace the "at" with @. We write the email this way to combat email spammers). We answer questions like yours all the time and we would be glad to hear your story. Just remember, because of Bar rules we can only mail the book to you if you have a Maryland address.
